1. Acceptance of Terms

By accessing or using EasyOTP ("Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines or rules posted within the Service.

If you do not agree, do not use the Service.

These Terms form a binding agreement between Heaberlin Ventures LLC d/b/a EasyOTP ("EasyOTP", "we", "us", or "our") and you, the user ("you" or "your").

2. Description of Service

EasyOTP provides an API and dashboard for sending and verifying one-time passwords (OTPs) via SMS, email, and voice for authentication and verification purposes.

The Service includes the website (https://www.easyotp.dev), API, and related documentation, integrations, and support resources.

3. Eligibility

• You must be at least 18 years old and legally able to enter into contracts to use the Service.
• By using the Service, you represent that all information you provide is accurate and that you have authority to bind your organization, if applicable.

4. Accounts and API Keys

To access the Service, you may need to create an account and obtain API credentials.

You are responsible for:

• Maintaining the confidentiality of your credentials.
• All activity conducted under your account.
• Promptly notifying us of any unauthorized use.

EasyOTP reserves the right to suspend or terminate accounts for suspicious or abusive activity.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or marketing content.
• Send OTPs or calls for unlawful, harmful, or deceptive purposes.
• Harass, abuse, or threaten any individual or entity.
• Attempt to bypass or abuse rate limits, quotas, or authentication.
• Interfere with or disrupt the Service or its infrastructure.

EasyOTP enforces a zero-tolerance policy toward fraudulent or abusive behavior. Violations may lead to immediate suspension or termination.

6. Credits and Billing

a. Credits

• EasyOTP operates on a credit-based system.
• 1 credit = 1 successful OTP send (SMS, email, or voice).
• Credits are consumed only for successful sends; failed sends do not consume credits.
• Credits never expire.
• Verification attempts are free.

b. Payments

• Purchases are final and non-refundable unless required by law or specified otherwise.
• Payments are processed securely through third-party providers.
• You authorize EasyOTP to charge your payment method for purchased credits or subscriptions.

c. Taxes

You are responsible for any applicable taxes, duties, or fees resulting from your use of the Service.

7. Service Availability and Support

We aim for high uptime and reliable message delivery but do not guarantee uninterrupted operation.

Delivery of SMS, voice, or email OTPs may depend on third-party networks outside our control.

8. Data Processing and Privacy

Our handling of data—including account information, OTP logs, and recipient details—is governed by our Privacy Policy.

By using the Service, you consent to the processing and storage of data in accordance with that policy.

9. Intellectual Property

All content, code, and technology of the Service are owned by Heaberlin Ventures LLC d/b/a EasyOTP and are protected by copyright, trademark, and other laws.

You retain ownership of any data or content you submit, but you grant EasyOTP a limited, non-exclusive license to process such data solely to provide the Service.

10. Termination

You may cancel your account at any time.

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms or applicable laws.
• Your account is used for abuse, fraud, or security risks.
• We discontinue or materially modify the Service.

Upon termination, your access to the Service and any unused credits may be revoked.

11. Disclaimers

The Service is provided "as is" and "as available."

We make no warranties—express or implied—regarding accuracy, reliability, or fitness for a particular purpose.

We do not guarantee delivery of all OTPs, as carrier or network failures are beyond our control.

12. Limitation of Liability

To the fullest extent permitted by law:

• EasyOTP shall not be liable for any indirect, incidental, consequential, or punitive damages.
• Our total liability for any claim shall not exceed the amount you paid to EasyOTP in the past 6 months.

13. Indemnification

You agree to indemnify, defend, and hold harmless Heaberlin Ventures LLC d/b/a EasyOTP, its officers, employees, and affiliates from any claims, damages, or expenses arising out of:

• Your use of the Service;
• Violation of these Terms;
• Violation of any law or third-party rights.

14. Changes to the Service or Terms

We may modify, suspend, or discontinue any aspect of the Service at any time.

We may update these Terms periodically, and the latest version will always be posted at https://www.easyotp.dev/terms.

Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, USA, without regard to its conflict-of-law principles.

Any dispute shall be brought exclusively in the state or federal courts located in Colorado.
